Comparing mortuary rituals across 57 representative cultures extracted from the Human Relations Area Files, this paper demonstrates that kin of the deceased engage in behaviours to prepare the deceased for disposal that entail close and often prolonged contact with the contaminating corpse. At first glance, such practices are costly and lack obvious payoffs. Building on prior functionalist approaches, we present an explanation of corpse treatment that takes account of the unique adaptive challenges entailed by the death of a loved one. (...) We propose that intimate contact with the corpse provides the bereaved with extensive veridical cues of death, thereby facilitating acceleration of a grieving process that serves to recategorize the deceased as no longer a relationship partner, opening the door to relationship replacement and a return to social functioning. The benefits of exposure to such cues are tempered by the costs of exposure to cues of disease risk, a balance that in part explains the relative rarity of highly invasive mortuary practices that exacerbate the latter factor. We conclude by discussing implications of our model for contemporary mortuary practices in the developed world. (shrink)

There is considerable evidence that beliefs in supernatural punishment decrease self-interested behavior and increase cooperation amongst group members. To date, research has largely focused on beliefs concerning omniscient moralistic gods in large-scale societies. While there is an abundance of ethnographic accounts documenting fear of supernatural punishment, there is a dearth of systematic cross-cultural comparative quantitative evidence as to whether belief in supernatural agents with limited powers in small-scale societies also exert these effects. Here, we examine information extracted from the Human (...) Relations Area Files on cultural discourse about the recently deceased, local ancestor spirits, and mortuary practices across 57 representative cultures. We find evidence that in traditional small-scale societies ancestor spirits are commonly believed to be capable of inflicting harm, with many attendant practices aimed at mitigating this danger. However, such beliefs do not appear to promote cooperation, as ancestor spirits seem to be concerned with interactions between themselves and the living, and to prioritize their own welfare. Many attendant practices are inconsistent even with bipartite cooperation with ancestors that could be viewed as a model for other relationships. The broader implications of this research for the cultural evolution of religion are discussed. (shrink)

Executive functions (EFs) and impulsivity are dimensions of self-regulation that are both related to psychopathology. However, self-report measures of impulsivity and laboratory EF tasks typically display small correlations, and existing research indicates that impulsivity and EFs may tap separate aspects of self-regulation that independently statistically predict psychopathology in adulthood. However, relationships between EFs, impulsivity, and psychopathology may be different in childhood compared to adulthood. Here, we examine whether these patterns hold in the baseline assessment of the Adolescent Brain and Cognitive (...) Development (ABCD) sample, a national sample of over 11,000 children (including 749 twin pairs) ages 9–10 years. We examine the phenotypic and genetic relationships among latent variables for different components of EFs and multiple facets of impulsivity. Additionally, we assess how EFs and impulsivity relate to composite measures and latent variables of psychopathology derived from parent report. EFs were weakly correlated with impulsivity, and the strength varied by impulsivity facet, emphasizing their separability. We did not identify significant genetic and environmental correlations between EFs and impulsivity. Moreover, controlling for their small relationships with each other, both EFs and some facets of impulsivity statistically predicted an Externalizing factor, attention problems, and social problems, and twin analyses suggested these relationships were genetic in origin. These findings indicate that EFs and impulsivity represent phenotypically and genetically separable aspects of self-regulation that are both transdiagnostic correlates of psychopathology in childhood. Structural equation modelling (SEM) is outlined and compared with two non-linear alternatives, artificial neural networks and ''fast and frugal'' models. One particular non-linear decision-making situation is discussed, that exemplified by a lexicographic semi-order. We illustrate the use of SEM on a dataset derived from 539 volunteers' responses to questions about food-related risks. Our conclusion is that SEM is a useful member of the armoury of techniques available to the student of human judgement: it subsumes several multivariate statistical techniques and permits (...) their flexible combination, and it provides robust goodness-of-fit statistics and is available in (generally) easy-to-use computer packages. Although the number of tasks for which SEM provides a persuasive psychological model is small, it is very useful in identifying the important variables and their inter-relations that contribute to task performance, and thus can constitute a valuable intermediate staging point between raw data and a fully fledged psychological theory. There is limited consensus about what constitutes humanly sensitive care, or how it can be sustained in care settings. A new humanised care assessment tool may point to caring practices that are up to the task of meeting persons as humans within busy healthcare environments. This paper describes qualitative development of a tool that is conceptually sensitive to human dimensions of care informed by a life‐world philosophical orientation. Items were generated to reflect eight theoretical dimensions that constitute what makes care (...) feel humanly focused. An action research group process in 2014–2015 with researchers, service users, healthcare professionals in two diverse clinical settings (stroke rehabilitation and dermatology) was used. Feedback on conceptual content, transparency of meaning and readability was then gained from a panel in Sweden and third‐year student nurses in the UK. The tool can be applied to attune staff to human dimensions of care, offering items which point to concrete examples of humanising and dehumanising features of practice in ways that have not yet been fully captured in the caring literature. Based on theoretically led experiential items, with dedicated focus on what makes people feel more, or less than human, it may offer improvement on available assessments of care. (shrink)

Social prescriptions are one term commonly used to describe non-pharmaceutical approaches to healthcare and are gaining popularity in the community, with evidence highlighting psychological benefits of reduced anxiety, depression and improved mood and physiological benefits of reduced risk of cardiovascular disease and reduced hypertension. The relationship between human health benefits and planetary health benefits is also noted. There are, however, numerous barriers, such as duration and frequencies to participate in activities, access, suitability, volition and a range of unpredictable variables impeding (...) a comprehensive approach to their use on a wider scale. From a multidisciplinary perspective, this commentary incorporates a salutogenic and nature-based approach to health, we also provide a range of recommendations that can be undertaken at the patient level to assist in shifting the acknowledged systemic barriers currently occurring. These include using simple language to explain the purpose of health empowerment scripts, ensuing personal commitment to a minimum timeframe, enabling ease of access, co-designing a script program, providing ongoing motivational support and incorporating mindfulness to counter unexpected disruptions. We propose Rhythmic Relating for autism: a system of supports for friends, therapists, parents, and educators; a system which aims to augment bidirectional communication and complement existing therapeutic approaches. We begin by summarizing the developmental significance of social timing and the social-motor-synchrony challenges observed in early autism. Meta-analyses conclude the early primacy of such challenges, yet cite the lack of focused therapies. We identify core relational parameters in support of social-motor-synchrony and systematize these using the communicative musicality constructs: pulse; quality; (...) and narrative. Rhythmic Relating aims to augment the clarity, contiguity, and pulse-beat of spontaneous behavior by recruiting rhythmic supports and relatable vitality; facilitating the predictive flow and just-ahead-in-time planning needed for good-enough social timing. From here, we describe possibilities for playful therapeutic interaction, small-step co-regulation, and layered sensorimotor integration. Lastly, we include several clinical case examples demonstrating the use of Rhythmic Relating within four different therapeutic approaches. These clinical case examples are introduced here and several more are included in the Supplementary Material. A suite of pilot intervention studies is proposed to assess the efficacy of combining Rhythmic Relating with different therapeutic approaches in playful work with individuals with autism. Despite enthusiastic claims around the benefits of corporate volunteering for the workplace and its widespread implementation, the impact of such programs for beneficiaries and non-profit organizations remains uncertain, particularly when employees’ participation is one-off. Previous research suggests that the benefits of CV for employees, businesses, and society are more likely to occur if employees internalize a volunteer identity—that is, if being a volunteer becomes a part of their self. This leads them to sustain their participation in CV over time, maximizing (...) CV’s positive effects on all stakeholders. This study explores the factors explaining why employees internalize a volunteer identity in a corporate context. We do so by empirically testing Grant’s :589-615, 2012) volunteer work design theoretical model with a sample of 619 employees involved in CV programs, and by comparing its relevance with an alternative, extended model relying on insights from self-determination theory. Whereas we find only partial and weak empirical support for the VWD model, our SDT-extended model is supported empirically. These results show that the quality of motivation that employees experience while volunteering plays a more important role than repeated participation, as it illuminates the process of how factors such as the quality of the projects, organizational support for CV, as well as the causes targeted affect the internalization of a volunteer identity. In particular, we show that employees are more likely to internalize a volunteer identity if they can choose what cause to engage for and if they feel that the projects they participate in are meaningful. Surprisingly, we also show that a prestigious cause as well as recognition and managerial support foster a controlled form of motivation for employees, which are then unlikely to internalize a volunteer identity. In doing so, we contribute to a better understanding of how CV can have lasting benefits for both business and society, and provide business leaders with actionable insights about how to design impactful CV programs. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. We can imagine a world in which ectogenesis provides a safe gestating space that eliminates maternal morbidity and mortality while maximising healthy outcomes for babies. In this world, women, no longer physically—and visibly—pregnant, are no longer economically, socially or physically disadvantaged due to the potential for pregnancy and birth. Because everyone can access the same technology, women are able to work without fear of pregnancy-related discrimination or restrictions, and health disparities among individuals in gestation and birth based on socioeconomic status (...) are eliminated. This imagining allows us to explore the ethical and social underpinnings of such a world, and consider how to achieve it in our current paradigm. Having explored the freedom and equality that is possible in an ideal hypothetical where all have equal access to such technologies, we can now imagine that same world without ectogenesis: women, no longer economically, socially or physically disadvantaged due to pregnancy and birth, despite still becoming pregnant. Such is the potential political perspective and provocation that can be spurred on by discussion of ectogenesis. But beneath the surface a much darker lesson lurks: that when our fantasies feel real, and have the power to hurt, they are no longer just a game. Both Buddhist meditation and micro-phenomenology start from the observation that our experience escapes us, we don’t see it as it is. Both offer devices that allow us to become aware of it. But, surprisingly, the two approaches offer few precise descriptions of the processes which veil experience, and of those which make it possible to dissipate these veils. This article is an attempt to put in parentheses declarative writings on the veiling and unveiling processes and their epistemological background and to (...) collect procedural descriptions of this veiling and unveiling processes. From written and oral meditation teachings on the one hand, micro-phenomenological interviews applied to meditative experience and to themselves on the other hand, we identified four types of veiling processes which contribute to screen what is there, and ultimately to generate the naïve belief in the existence of an external reality independent of the mind: attentional, emotional, intentional and cognitive veils. The first part of the article describes these veiling processes and the processes through which they dissipate. It leads to the identification of several “gestures” conducive to this unveiling. Partant de l’analyse anthropologique des âges de la vie par Hegel dans l’Encyclopédie, on présentera sa critique des idéaux. Hegel fustige chez le jeune homme cette tendance à opposer le réel et l’idéal. Il dégage les risques à la fois individuels et collectifs que cette vision du monde fait courir et considère « l’homme fait » comme celui qui sait vouloir ce qui est. De cette analyse, suit la conclusion qu’il n’y a pas de possible en dehors du réel, pas (...) de substantialité hors du monde. Autrement dit, et contre la première impression de la plupart des hommes, possible et réel, devoir être et être, s’identifient. Pourtant, si l’aversion du réel inspirée par l’attachement aux idéaux représente, selon Hegel, un danger, le procès du devoir-être par la philosophie spéculative n’est pas non plus sans risque. Ne signe-t-il pas, comme le dira Nietzsche, la défaite de la volonté face au poids des choses ? La lecture, dans la Doctrine de l’essence, du chapitre intitulé « L’effectivité » dans la section du même nom, peut nous préserver de conclusions si déprimantes, car celui-ci vient expliquer, non que le possible est une chimère, une vue de l’esprit, mais qu’il s’identifie à l’effectif. Or, la reconnaissance de cette intimité produit d’une part en retour une conception plus riche, plus haute, plus noble du possible – elle lui donne en somme des lettres de noblesse – et, d’autre part, elle conduit à y lire une affirmation de la contingence. Notre argumentaire vise à établir qu’en disant que l’effectif est possible et que le possible est effectif, Hegel ne les détruit pas en leur ôtant leurs déterminations propres, mais leur assure une plus grande consistance. En étant possible, l’effectif cesse de se confondre avec la réalité comprise comme simple existence ou simple phénomène, comme simple il y a. En étant effectif, le possible cesse de signifier un moindre-être, un en deçà, un simplement ou seulement possible, puisqu’il est alors inscrit dans l’être, dans le monde. (shrink)

Au sortir de la guerre, Merleau-Ponty considérait que tout ce qu’on croyait pensé et bien pensé – la liberté et les pouvoirs, la citoyenneté – est en ruine. En 1960, la Préface de Signes semble reconduire le constat, attestant cette fois de l’échec des philosophies de l’histoire dont les Aventures de la dialectique dessinaient le premier volet. Si la critique marxienne apparaissait contribuer à la clarté politique et constituer la réponse adéquate à une période de crise, quelle opportunité reste-t-il au (...) philosophe une fois la rupture avec le marxisme consommée? A l’abandon pur et simple de la philosophie politique suggéré par les interprètes et par le texte de Merleau-Ponty lui-même en certains endroits – « n’est-ce pas un incroyable malentendu si tous les philosophes ou presque se sont crus obligés d’avoir une politique? » (S, 13) – il faut préférer l’alternative de la philosophie militante, mentionnée à partir de 1956 en deux lieux textuels, seule issue possible d’une philosophie ayant abandonné ses droits au système sans se résoudre au mutisme – soit, dans une perspective encore marxiste, l’après devenir-monde de la philosophie. Comment dès lors conjuguer l’apparition du syntagme en 1946, où il semble réservé à la pensée de Marx par contraste avec la philosophie triomphante hégélienne, et son maintien hors du cadre de référence marxien, lorsque ce dernier est devenu, selon les dires de Merleau-Ponty lui-même, un auteur qu’il convient de méditer à la manière d’un classique? L’insuccès des pensées systématiques de l’histoire et des figures classiques de l’engagement (Sartre, Boukharine) dévoile la nécessité pour Merleau-Ponty d’interroger continument son expérience politique et la raison d’être de son militantisme, inscrit dans la chair de l’histoire.As the war ended, Merleau-Ponty considered that everything thought to be good and well thought – freedom, powers, citizenship – was in ruin. If the Marxist critique appeared to contribute to political clarity and to consist in an adequate response to a period of crisis, what opportunities remain for philosophy once the rupture with Marxism is finalized? To the pure and simple abandonment of political philosophy suggested by interpreters and by Merleau-Ponty’s text itself in certain instances – “Is it not an incredible misunderstanding that all, or almost all, philosophers have felt obliged to have a politics?” (S, 5) – one must favor the alternative of militant philosophy, first mentioned in 1956 in two textual locations. This alternative is the only outcome possible for a philosophy that has abandoned its rights to the system without resolving itself to silence. It is, from a still-Marxist perspective, the post becoming-world of philosophy. How, then, can we reconcile the appearance of the phrase in 1946 – where it seems reserved to Marxist thought in contrast with the triumphant Hegelian philosophy – with its retention outside of Marxist references, even as Marx has become, according to Merleau-Ponty himself, a writer who should be reflected upon as a classic? Come coniugare allora l’apparizione del sintagma nel 1946, apparentemente riservato al pensiero di Marx in contrasto con la filosofia hegeliana trionfante, con la sua salvaguardia fuori dal quadro di riferimento marxiano, dal momento in cui quest’ultimo è diventato, secondo lo stesso Merleau-Ponty, un autore sui cui è necessario riflettere alla maniera di un classico? L’insuccesso delle filosofie sistematiche della storia e delle figure classiche dell’impegno (Sartre, Bucharin) rivela la necessità per Merleau-Ponty d’interrogare continuamente la sua esperienza politica e la ragion d’essere della sua militanza, iscritta nella carne della storia. L’admiration de Paul Ricoeur pour Merleau-Ponty est connue, lui qui entendait donner à la Phénoménologie de la perception sa « contrepartie pratique » avec le premier tome de la Philosophie de la volonté, Le Volontaire et l’involontaire. Il faut d’emblée s’étonner que celui-ci n’ait pas reconnu la teneur pratique de la philosophie de son aîné, dont les diverses analyses au Collège de France, et en particulier l’intérêt marqué de Merleau-Ponty pour la pensée marxiste comme philosophie de l’homme charnel, et le (...) motif naturaliste de l’être agissant et souffrant à partir de 1956, font état. Car c’est bien depuis ce motif que Ricoeur, en 2004, expose le parcours de la reconnaissance : de l’homme agissant et souffrant, à l’homme capable. L’enjeu, nous semble-t-il alors, de ces deux philosophies en leur dimension pratique se résume aisément par les exigences formulées par Paul Ricoeur dans l’ouvrage Soi-même comme un autre, en particulier lorsque celui-ci se donne pour but de « déterminer les traits nouveaux de l’ipséité correspondant à la pratique politique » – détermination du Soi agent qui se dessine, au dire même de l’auteur, à la croisée d’une phénoménologie de l’agir et d’une ontologie du Soi. En effet, comme le souligne Ricoeur, l’effacement paradoxal de la question de l’ipséité dans la philosophie morale kantienne, entre autres, s’explique par l’absence d’une telle théorie de l’action. En bref, le « Je veux » analysé en 1950 par Ricoeur s’ancre dans un « Je peux », qui ne se limite jamais au seul plan spatial chez Merleau-Ponty. Ainsi, à la figure phénoménologique de nos expériences de la passivité correspond la catégorie ontologique de l’altérité, mentionnée par l’expression du Visible et de l’invisible reprise en titre de cet article et dont l’attribution à Ricoeur ne choquerait pas.Paul Ricoeur’s admiration for Merleau-Ponty is well-known given that he presented his “practical counterpart” to the Phenomenology of Perception in the form of his Freedom and Nature: The Voluntary and the Involuntary. One is immediately surprised that this is not recognized as the practical content of his predecessor’s philosophy given the diverse analyses at the Collège de France of which, in particular, the marked interest Merleau-Ponty had in Marxist thought as the philosophy of the fleshly human being, as well as the naturalist motif of the active and suffering being beginning in 1956, are part. For, it is due to this motif that Ricoeur, in 2004, presents the trajectory of recognition: from the active and suffering human being to the capable human being. As we see them, the stakes in these two philosophies, as far as their practical dimensions are concerned, are easily summarized by the requirements Paul Ricoeur formulated in his work, Oneself as Another. This is particularly the case given that this text has for its aim, “determining the new traits of individual identity which correspond to practical politics” – the determination of Self as a self-designing agent, which, according to the author, lies at the intersection of a phenomenology of action and an ontology of the Self. In fact, as Ricoeur himself underlines, the paradoxical effacement of the question of ipseity in Kantian moral philosophy, among others, is explained by the absence of just such a theory of action. Briefly, the “I want” analysis by Ricoeur in 1950 is anchored in the “I can,” which is never limited to the single spatial outline we find in Merleau-Ponty. Thus, to the phenomenological figure of our experiences of passivity correspond the ontological category of alterity, as mentioned in the phrase from The Visible and the Invisible taken up in the title of this article and which it would not be shocking to attribute to Ricoeur.È ben nota l’ammirazione di Paul Ricoeur per Merleau-Ponty: col primo tomo della Philosophie de la volonté, intitolato Le Volontaire et l’involontaire, Paul Ricoeur intendeva offrire alla Fenomenologia della percezione una vera e propria “contropartita pratica”. La posta in gioco, ci sembra, di queste due filosofie, considerate nella loro dimensione pratica, si riassume facilmente nelle esigenze che Ricoeur formula nel suo libro Sé come un altro, in particolare quando si assegna il compito di “determinare i tratti peculiari dell’ipseità corrispondente alla pratica politica” – cioè di determinare i tratti di quel Sé agente che si delinea, a dire dell’autore stesso, al crocevia tra una fenomenologia dell’agire e un’ontologia del Sé. In effetti, come sottolinea Ricoeur, la paradossale cancellazione dell’ipseità operata dalla filosofia morale kantiana si spiega tra l’altro con l’assenza di una adeguata teoria dell’azione. In breve, l’“Io voglio” analizzato da Ricoeur nel 1950 si àncora in un “Io posso” che non si limita mai, in Merleau-Ponty, al solo piano spaziale. Così, alla figura fenomenologica delle nostre esperienze di passività, corrisponde la categoria ontologica dell’alterità, che proprio Il visibile e l’invisibile menziona con l’espressione che noi riprendiamo nel titolo di questo articolo e che ci si aspetterebbe essere anzitutto ricoeuriana. Les individus cherchent leurs marques dans de grands ensembles flottants : que faire pour vivre bien? Rompre avec tel ou tel formalisme ambiant? Durcir une ritualité traditionnelle? Les sentiments peuvent être très mêlés : l'identité de la personne humaine sera-t-elle renforcée grâce à une communauté de forte appartenance? Mais cette recherche d'identification n'est-elle pas habitée par la crainte d'un étouffement au sein d'un vivre-en-commun? Des pas de géant ont été accomplis pour critiquer la primauté de la communauté traditionnelle sur l'individu, (...) mais pas partout. Et l'individu a rencontré l'Etat sur son chemin, ce qui renvoie au fameux dilemme de J.-J. Rousseau : homme ou citoyen? La critique d'un vivre-en-commun selon des normes et des valeurs a pu s'appuyer sur l'universalité des Droits de l'homme, malgré l'ambiguïté de ces derniers. Le philosophe A. Clair met en valeur un tiers droit, celui de la fraternité. Dialoguant avec l'œuvre de H. Arendt, l'auteur approfondit notamment les relations entre l'autorité, la tradition et la religion ; de même qu'il discute la pensée communautarienne et l'œuvre de A. McIntyre : A. Clair entreprend de critiquer l'individualisme libéral et n'hésite pas à méditer à nouveaux frais la thèse de Machiavel sur la violence comme fondatrice des institutions. Qu'en est-il de la singularité historique de la communauté comme présence de l'humanité? Sans jamais prôner un quelconque communautarisme, l'auteur reprend, selon une argumentation courageuse, la question de la tension entre norme de vie bonne et vie en société. (shrink)

Traiano Boccalini (1556-1613) auteur des Ragguagli di Parnaso (1612 et 1613) prend position dans le débat sur l’interprétation républicaine de Machiavel : l’auteur du Prince a-t-il écrit pour aider la monarchie ou bien contre elle ? Boccalini semble prendre une position nuancée, affirmant que si l’on condamne Machiavel c’est justement parce qu’il pourrait trop bien servir aux républicains. Lui-même utilise la métaphore du berger, traditionnellement liée à l’idée religieuse, pour montrer que le monarque n’est pas le berger désintéressé du troupeau (...) humain comme il voudrait le faire croire, mais un berger tout attaché au profit qu’il peut tirer de ses brebis. L’ironie dénonce une image pastorale (idyllique) de la monarchie mais Boccalini n’en n'appelle pas pour autant au soulèvement, source des plus grandes souffrances. (shrink)

Economists typically assume that preferences are fixed-that people know what they like and how much they like it relative to all other things, and that this rank-ordering is stable over time. But this assumption has never been accepted by any other discipline. Economists are increasingly having difficulty arguing that the assumption is true enough to generate useful predictions and explanations. Indeed, law and economics scholars increasingly acknowledge that preferences are constructed, and that the law itself can help construct preferences. Still, (...) fixed preferences are often treated as a normative ideal: Even if people don't have fixed preferences, they should. Behavioral law and economics scholars offer approaches to deal with this normative shortcoming. My article argues that preference construction, properly understood, is not normatively undesirable. Having fixed preferences means having a complete and stable rank ordering of what we want that dictates our choices. But we often do not have such an ordering, and rationally so. My article argues instead for an alternative process-based, account of preference construction. Rather than having a complete rank ordering, we have ways of making choices. We construct narratives, using evaluative criteria against a backdrop of wants, desires and inclinations, some of which we rank order and some of which we do not. The evaluative criteria embed a consideration of transaction costs: critically, where a decision is not very consequential, a formulaic decision rule that permits a ready choice among roughly comparable alternatives may serve our purposes better than a more considered alternative-by-alternative assessment. Our wants, desires and inclinations are for both traditional objects of choice and higher order values and desires; they are both previously constructed and constructed and elicited in the choice-making process. My article makes the case for such an account's potential explanatory power, as well as its tractability. (shrink)

Rousseau est certainement un des écrivains français qui interroge le plus car la multiplicité de son oeuvre reflète une ambiguïté. C'est en effet l'homme du discours logique et de la rêverie, de l'oeuvre philosophique, politique, lyrique et intime: un long itinéraire ‘de la marche de la raison au tragique de la recherche d'un salut individuel’.1 Ce qui nous intéresse ici, c'est l'aspect intime, c'est Rousseau intimiste dans son rapport avec la culture ou les cultures; sa démarche et son interrogation sur (...) le monde sont au coeur de sa vie.Nous voudrions cerner dans quelle mesure les diaristes du XIXé siècle sont les héritiers de la révolution intérieure de Rousseau, révolution qui met en cause les cultures. The central theme of the volume is cultural diversity, a vast subject that is highly relevant today. The particular focus here is on the many ways in which this diversity is managed within the framework of State law. The twelve contributors to this book have a special interest in how cultural traditions and their various forms of expression are handled by the law. They were all participants in the 2009 Research Programme of the Centre for Studies and Research of the (...) Hague Academy of International Law. The breadth of the subject is reflected in the wide spectrum of perspectives from which the topic has been explored. Starting in each case from the existing State and international legal frameworks, the contributors explore how the interactions between positive law and other normative orders can be placed at the service of a legal system that is as fair as possible within a plural context. Contributors were asked to choose from two alternative approaches: either they could look at cultural diversity issues in the field of private (international) law, a fairly traditional field that is especially relevant to the legal treatment of cultural diversity; or they could situate cultural diversity within the wider and more theoretical area of "legal pluralism", whether on a local or regional level or at the international (United Nations) level.
